This website, Pasticceria Gallina (hereinafter the “Website”), and its trademark are owned by Pasticceria Gallina Srl, with registered and administrative office at Via Vochieri, 46 – 15121 Alessandria (Italy), VAT No. 02235230063, and is intended for retail sales to individuals identified by the information entered when completing the registration form (hereinafter referred to as the “Customer”). Pasticceria Gallina complies with the legislation governing distance selling (Italian Legislative Decree No. 206/2005).
1. General Terms and Conditions
These General Terms and Conditions of Sale are the only terms applicable and replace any other terms and conditions, unless otherwise agreed in writing.
Pasticceria Gallina reserves the right to amend these General Terms and Conditions of Sale. Customers are therefore advised to review them before placing an order on the Website www.pasticceriagallina.it.
Any amendments shall become binding on the Customer as soon as they are published and shall not apply to contracts entered into before their publication.
By confirming an order, the Customer is deemed to have read and accepted these General Terms and Conditions of Sale without reservation.
Shipping and payment methods are described in detail in the relevant sections and shall be considered an integral and essential part of this agreement.
The methods used for processing personal data (Privacy Policy) are described in the relevant section and shall likewise be considered an integral part of this agreement.
2. Website Registration
In order to make purchases on the Website, users must register for an account.
All other activities that users may carry out on the Website do not require registration.
3. Prices on the Website
All prices displayed on the Website include VAT.
Shipping costs and any discounts resulting from promotional codes are not included.
Pasticceria Gallina reserves the right to change its sales prices at any time and without prior notice.
4. Invoicing and Accompanying Documents
Each order will be accompanied by a valid commercial invoice or other appropriate accompanying document and/or a valid fiscal receipt.
5. Products
Product images displayed on the Website are for illustrative purposes only and are not binding.
However, the price of the product will not differ from the price indicated at the time the order is placed.
6. Order Acceptance
An order submitted by the Customer shall be binding upon Pasticceria Gallina only if the entire ordering procedure has been completed correctly and successfully, without the Website displaying any error messages.
The Customer will receive an order confirmation by email, including a summary of the products ordered, the relevant prices, and the general and specific terms and conditions applicable to the order.
7. Order Cancellation
In addition to the provisions set out in Section 8 below, the Customer may cancel the entire order only by 9:00 a.m. on the first working day following the date on which the order was placed.
Any cancellation request received by Pasticceria Gallina after this deadline shall not be accepted.
Orders already received by Pasticceria Gallina cannot be amended. Therefore, if an incorrect order has been placed, the Customer must cancel it and subsequently place a new order through the Website for the desired products.
To cancel an order, the Customer must send an email to info@pasticceriagallina.it, specifying the relevant order number.
8. Right of Withdrawal
In accordance with Article 55 of the Italian Consumer Code, Legislative Decree No. 206 of 6 September 2005, as subsequently amended and supplemented, perishable products, products with a short shelf life, or products liable to deteriorate are excluded from the right of withdrawal.
9. Payment
Purchases may be paid for by credit card, PayPal, Satispay or bank transfer.
Pasticceria Gallina reserves the right to update the available payment methods depending on the period.
10. Delivery
Orders placed through www.pasticceriagallina.it are delivered by courier.
11. Privacy
Pasticceria Gallina will process the Customer’s personal data in accordance with Article 13 of Italian Legislative Decree No. 196 of 30 June 2003 (“Personal Data Protection Code”) and Articles 13 and 14 of EU Regulation No. 2016/679 (“General Data Protection Regulation” or “GDPR”), to which reference is made for further information.

14. Governing Law and Jurisdiction
These Terms and Conditions of Sale are governed by Italian law.
For any matter not expressly covered by these Terms and Conditions, reference is made to Italian Legislative Decree No. 185/99, “Implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts”.
Any dispute concerning these Terms and Conditions or the purchase and sale of products shall be subject to the jurisdiction of the competent court.
