ACCEPTANCE FOR THE ORDER AND CONCLUSION OF THE CONTRACT.
The order transmitted will be carried out through several stages:
When the customer sends the order, he submits a proposal of purchase of the selected product/s. The dispatch of the order implies the consent (pursuant to Article 10 DL 185/1999) to receive communications from Pasticceria Gallina, that are exclusively intended for the fulfilment and the conclusion of contractual obligations.
Successively to it, Pasticceria Gallina will confirm the order, modifying its status and notifying of such change the customer via a confirmation email (for this reason the real existence of the e-mail address given during the registration process is crucial).
The order could eventually be cancelled (to be defined)
Once received the e-mail of order confirmation, the customer can execute the payment. The speediness required to this phase is dependent on the Customer; the faster the payment is executed, the quicker the preparation and the shipment of the merchandise.
Once we receive the payment receipt and the confirmation that our bank has received your funds, Pasticceria Galllina commits itself to give the parcel to the express courier as soon as possible.
In any case, the purchased merchandise will be delivered within the deadlines established by the art. 6 Dlgs 185/1999. No responsibility for failed delivery or delayed delivery can be charged to Pasticceria Gallina in case of force majeure or unforeseeable circumstances. Pasticceria Gallina shall not be liable for damages caused by the courier; Pasticceria Gallina remains uninvolved in any relationship between the customer and the courier.
RIGHT OF WITHDRAWAL:
In accordance with DLgs. 206/2005, considering the merchandise as perishable goods, the right of withdrawal is covered by art. 55 c.1 let.a.. For this reason, the right of withdrawal is not exercisable by the customer.
The prices are indicated in the product section. All the prices include VAT.
The sales contract between the customer and Pasticceria Gallina is concluded in Italy and, therefore, governed by the Italian law.
